Construction

Construction is one of important constituents of the firm’s practice.  Recently, the volume of the firm’s consultations in this sphere has considerably increased because of the current construction boom in the country.  The lawyers of the firm represent the clients on a wide range of issues related to major construction projects in different branches of industry, social infrastructure facilities and residential construction.  The major foreign and Kazakhstan companies are the clients of the firm in this sector.

Our most representative experience in this area includes:

-                 advice to Kazakhstan’s largest construction corporation Bazis-A and its subsidiaries on a number of projects over the past several years;

-                 advice to a number of major construction companies and banks of South Korea on a wide range of issues of construction and financing of construction projects and related issues pertaining to their projects in Kazakhstan, including the issues of land withdrawal for construction of a complex of residential and administrative buildings, as well as social projects (complex microdistricts) in Almaty and Astana;

-                 advice to the international University of Central Asia established under the International Treaty among the Republic of Tajikistan, Kyrgyz Republic, Republic of Kazakhstan and Ismaili Imamat on all issues of the University campus design and construction in Tekeli, including regulatory issues pertaining to land plot selection, perfection of rights to the land under the plot and facility commissioning;

-                 advice to the Government of the Republic of Kazakhstan in connection with a disputable legal relationship with a group of foreign contracting companies pertaining to reconstruction (construction) of a section of Almaty-Astana highway, including advice on regulatory issues of construction and capital contracting under the earlier (Soviet) and current Kazakhstan legislation;

-                 advice to Tengizchevroil LLP on residential construction issues and drafting of a package contract for residential settlement construction for employees in Atyrau;

-                 advice to a major Italian construction company Impregilo SpA on local law issues in connection with an irrigation system construction project financed by the World Bank, including analysis of disputable legal relations with the governmental bodies concerning commissioning of construction facilities and final mutual settlements;

-                 advice to a major financial and industrial Bonita Group engaging in the financing and construction of large projects in connection with the contemplated construction of a unique mountain ski complex and Olympic village at the foothills of Zailiysky Alatau, including issues of lands transfer from “special protection” category into other categories to be used in commercial projects;

-                 representation of PetroKazakhstan Inc. in connection with acquisition of unfinished residential facilites, including assistance in the registration of the rights to land plots and title to such project facilities.

The firm also represented other clients on matters related to civil and industrial construction.
