Labor issues are among the key spheres of interest for our clients.  During work we have to resolve a great number of issues, including drafting and legal review of employment agreements and collective agreements, regulation of foreign employees labor, employees with non-standard working day and rotating employees, representation of clients in relations with the state agencies and trade unions, obtaining work permits for foreign employees, advice on the issues of remuneration, liabilities of employees and employers, labor safety, compensations, business trips, etc.  Aequitas lawyers are often resolving non-standard problems, which are not clearly regulated by the current labor legislation.  We have a vast experience of protecting the interests of both employers and employees of the local and foreign companies.

The firm’s lawyers regularly publish analytical articles on different aspects of law in specialized magazines in Kazakhstan and abroad and prepare local labor regulation reviews published in the World Bank’s annual Doing Business In reports (2005-2010).

Our most representative experience in this area includes:

-                 advice to Exxon Mobil group of companies on a wide range of labor law issues, including entering into and termination of employment agreements, working time, labor relations with the participation of foreign citizens, regulation of labor of employees with non-standard working day, work permit obtainment, liability for non-fulfillment of labor legislation requirements, collective agreements, pension legislation and company representation in relations with authorized agencies and in disputable labor relations in connection with its projects in Kazakhstan (since 1993 until present);

-                 advice to General Electric on various labor law matters: norm-setting for labor, working and rest time, including for rotation work, secondment of employees, disciplinary liability, and other aspects;

-                 ongoing advice to Mars on multiple labor law matters: hire to work, termination of labor relations, and transfer of employees, development of employment agreements, including for management, payment of salary, compensations and other additional payments, and other issues;

-                 advice to Colgate-Palmolive, including on company’s various labor matters, including preparation of employment agreements and analysis of salary, compensation and guarantee issues;

-                 advice to Jones Lang LaSalle on various labor law issues: hire to work and termination of labor relations with the company employees, including General Director, development of employment agreements, regulations and other employer’s acts;

-                 legal assistance to Nova Zinc LLP on labor matters relating to the rights and obligations of the employer and employees, legal analysis of the provisions of company internal acts and employment agreements, trade union activities and other issues;

-                 advice to Hewlett-Packard on a wide range of labor issues: fulfillment of state labor inspector’s ordinances, preparation of employment agreements, development of regulations on bonus payment to employees and drafting of other company internal documents, including job descriptions, staff schedules, orders, regulations, etc.;

-                 advice to Johnson & Johnson regarding termination of labor relations with employees on the grounds provided for by the current legislation and on other labor matters;

-                 advice to Scania Central Asia on the local labor law issues, including development tof employment agreements;

-                 advice to AIG Kazakhstan Insurance Company JSC on various local labor law issues, including protection of employees’ rights, conclusion and termination of employment agreements, compensations, and insurance of employer’s liability;

-                 legal assistance on labor relations of Volvo Central Asia AB in connection with its projects in Kazakhstan, including development of individual employment contracts, analysis of the issues of entering into and termination of employment contracts, salary, compensations and guarantees;

-                 advice to PetroKazakhstan Inc. on various aspects of labor law, including working and rest time, vacations, conclusion and termination of employment agreements, and staff restructuring in connection with its numerous projects in Kazakhstan;

-                 ongoing advice to Bechtel International Inc. and Enka Insaat ve Sanayi AS in connection with their joint activities on construction of infrastructure facilities servicing major oil companies’ projects at Tengiz and Caspian offshore zone on various labor matters, including regarding rotation work, drafting of employment agreements and collective agreements, compensations and guarantees, obtaining of work permits for foreign labor, etc., as well as representation of the company interests in disputable legal relations with authorized state labor agencies and employees;

-                 advice to Microsoft Airland Operations on local labor law issues, including drafting of employment agreements, confidentiality agreements, and agreements on assignment of intellectual property rights;

-                 advice to Lucent Technologies Nederland B.V. on various aspects of labor law, including drafting of employment agreements, analysis of remuneration, compensations and guarantees issues;

-                 ongoing advice to JV Saga Creek Gold Company LLP (a subsidiary of the Canadian gold-mining company) on various issues of local labor legislation, including protection of employees’ rights, conclusion and termination of employment agreements, compensations, and insurance of employer’s liability;

-                 advice and assistance to Caterpillar Overseas S.A. on labor matters and to its dealer, a large Turkish company, on disputable legal relations in connection with termination of employment agreement with its general manager;

-                 advice to a number of other companies on various aspects of local labor legislation and drafting of employment agreements and other documents.
