AEQUITAS Partner Semion Issyk took part in the Kazakhstan-Hungary Business Forum attended by the Prime Ministers of Kazakhstan and Hungary.   The event's main outcome was the signing of a number of bilateral agreements intended to expand business cooperation between the Kazakh and Hungarian investors and businessmen. In the course of numerous negotiations held between the Forum participants, representatives of large Hungarian industrial and production companies showed keen interest in AEQUITAS legal services to support the establishment and development of their business in Kazakhstan, coming to learn about AEQUITAS broad expertise and flexible and loyal approach.


April 2012

AEQUITAS Partner Nurlan Sholanov took part in the Round Table "Investor Participation in the Public Private Partnership Projects" held in the framework of the public-private partnership (PPP) practice development.  AEQUITAS was also engaged as an expert to discuss the Draft RK Law on Introduction of Amendments into Certain Legislative Acts of the Republic of Kazakhstan for the Introduction of New Forms of Public-Private Partnership and Expansion of Their Application Sphere.  AEQUITAS proposals were taken into consideration and used in the process of the Draft Law finalization.


20-23 April 2012

On 20 April 2012, CIS Leading Counsel Network (CIS LCN), including AEQUITAS, made a joint presentation at the "Doing Business in the CIS: Hot Issues" panel of the Spring Meeting of the American Bar Association (ABA) International Law Section which took place in New York.

Managing partners of the leading national law firms (AEQUITAS Managing Partner Olga Chentsova and Partner Tatyana Suleyeva among them) from key jurisdictions across the Commonwealth of Independent States (CIS) economic region presented a unique local insight and legal advice on the hot issues of doing business in the region, which is increasingly attracting international investments. The panel discussion included the most interesting developments concerning the business environment, M&A, and foreign investment issues. The audience not only learned about some of the world's most rapidly developing economies, but also got the best local advice on how to avoid traps and pitfalls and safeguard investments in Russia and the CIS region based on the local expertise of the panelists and participants.

The audience was presented with publications co-authored by LCN members: Comparative Summary of Anticorruption Laws in the CIS Economic Region, Comparative Summary of Antitrust Laws in the CIS Economic Region and CIS: Tax Compass.

Following a successful presentation in New York at the American Bar Association Spring Meeting, representatives of the CIS LCN travelled to Washington DC where they held a lunch discussion on 23 April 2012 at the offices of Paton Boggs LLP discussing legal issues and tips on doing business across the CIS. Nine senior partners representing every member of the CIS LCN, including Olga Chentsova and Tatyana Suleyeva, spoke at the event.


Kazakhstan Bar Association to Be Created in Kazakhstan

Once Kazakhstan acquired independence and developed into an independent participant of the global community, there arose an acute need for the normative regulation of the legal services market.

In order to improve the quality of legal services, the legal community has called for the creation of Kazakhstan Bar Association, a public association on the basis of voluntary membership implying mandatory compliance with certain requirements.

The key objective of the association will be to improve the legal services quality and elevate the lawyers’ professionalism, legal profession prestige and the public and company trust in lawyers.

Olga Chentsova and Yulia Chumachenko (Managing Partner and Partner, AEQUITAS) took part in the IBA 5th Annual Law Firm Management Conference in Moscow, Russia organized by the IBA's European Regional Forum and Law Firm Management Committee in conjunction with LegalStudies.RU. 

The Conference was attended by more than two hundred law firm partners and governance specialists from 17 countries all over the world.


CIS Leading Counsel Network shortlisted for the British Legal Awards 2011 in the category European Legal Team of the Year

 

Nomination for the prestigious British Legal Awards reflects the outstanding professional level of the CIS Leading Counsel Network (CIS LCN), a pan-CIS network of the leading law firms that demonstrated their excellence advising on the Danone-Unimilk merger.

The British Legal Awards, hosted by a leading British publication Legal Week, set out to recognise the achievements of those law firms, teams and individuals who have performed most successfully during the last year. The shortlist and winners were chosen by an independent panel of judges made up of in-house lawyers, managing and senior partners and other senior business figures.

Egorov Puginsky Afanasiev & Partners (Russia), Vlasova, Mikhel & Partners (Belarus), Aequitas (Kazakhstan), RULG (Ukraine) and FINA (Azerbaijan) provided cross-border legal advice in the course of the Danone – Unimilk merger. Other members of the CIS LCN, namely Kalikova & Associates (Kyrgyzstan), Turcan Cazac (Moldova) and Ameria (Armenia) were also involved in the transaction providing merger control and compliance check in the respective jurisdictions.

15 October 2011

 

AEQUITAS found a scholarship named after Yuri G. Bassin, Doctor of Law, Professor and the founder of civil law in Kazakhstan.  Yuri G. Bassin was one of AEQUITAS founders and worked as its Partner for 12 years.

The scholarship will be granted to the best student of the law department of the Kazakh National University, who actively participates in scientific and social life.  The first scholarship holder is Arman Kazhdarov, third grade student.

The International Conference dedicated to the 20th anniversary of the CIS formation, Kazakhstan's independence and Kazakhstan’s antimonopoly agency was organized and held in Almaty by The Agency of the Republic of Kazakhstan for Competition Protection.

The representatives of the Parliament and Government of the Republic of Kazakhstan, heads of antimonopoly agencies from the CIS and far-abroad countries, heads of various Kazakhstan industry unions and associations, lawyers and economists took part in the Conference as speakers and guests. 

Yelena Bychkova, AEQUITAS associate and member of the Non-Profit Partnership “Competition Support in the CIS” spoke on “Unification of Antitrust Approaches to Transactions Involving Economic Concentration.”


6-7 October 2011

 

The Russian Journal “Mergers and Acquisitions” acted as a principal organizer of the Annual Conference “Mergers and Acquisitions in Russia and CIS” in Moscow.

The speakers at the conference were mostly the representatives of major banks and partners of law firms specializing in M&A.  The total number of the Conference participants was 168 persons, AEQUITAS being represented by its Partner, Natalya Braynina.

The speakers, among other things, were touching upon the issues of facility acquisition in the CIS by foreign corporations, antimonopoly regulation, restriction of foreign participation in strategic sectors and JV establishment trends in the CIS.  Ms. Braynina’s report was dedicated to legal aspects of mergers and acquisitions in the oil and gas sector of the Republic of Kazakhstan.

Yelena Manayenko, AEQUITAS Partner, took part in the Global Law Firms Conference held by Linklaters, one of the leading English law firms, in Hampshire, England.

The Conference mainly focused on the issues relating to the existence, development prospects and improvement of legal business (Leading a professional services firm, The law firm of the future), also touching upon investment management, transnational trading, retail and telecommunications issues.


29-30 September 2011 – AEQUITAS partners, Olga Chentsova and Tatyana Suleyeva, took part in the International Scientific and Practical Conference "Civil Law as Science: History, Theory and Practice Issues" held in the framework of annual civil law readings in Almaty, Kazakhstan.

This conference marked the 70th anniversary of the leading Kazakhstan's civil law expert, Member of Kazakhstan National Academy of Sciences, Doctor of Law, Professor Maidan Suleimenov, and was dedicated to the issues of civil legislation reforms in the CIS states.

The leading civil law experts from the CIS and far-abroad countries: Rolf Knipper, Professor, Bremen University; Veniamin F. Yakovlev, Advisor to the President of the Russian Federation, Head of Chair "Legal Support of Economy" of the Russian Academy of State Service, Associate Member of the Russian Academy of Sciences; Natalia S. Kuznetsova, Professor of the Civil Law Chair of the Taras Shevchenko Kiev National University, Member of Legal Sciences Academy; Lado Chanturia, Professor of Tbilisi State University and Kiel University; Tamara Ye. Abova, Head of the Civil Law, Civil Process and Arbitration Process Sector of the State and Law Institute of the Russian Academy of Sciences, and others, spoke at the conference.


On 12 September 2011, Olga Chentsova, AEQUITAS Managing Partner, and Violetta Kim, AEQUITAS Senior Advisor, took part in the 3rd Annual Conference "Resolution of CIS-Related Business Disputes" in Moscow organized by the ABA Section of International Law.

The Conference focused on the following issues: corruption in courts, insolvency litigation, professional responsibility dilemmas in international disputes, shareholder rights, protecting minorities and joint venture partners, third party funding of litigation and arbitration, state entities as parties in arbitration, and choice of law in cross-border transactions and was attended by the leading experts and global-level specialists.  The speakers featured representatives of the Russia and US justice authorities, international arbitrators, advisors with major Russian and foreign law firms and in-house lawyers of the leading Russian companies. 

On 7 September 2011 London was welcoming the CIS legal market leaders meeting organized by The Lawyer, a leading British legal publication, supported by the CIS Leading Counsel Network (LCN).

The audience included leading in-house counsel and representatives from the UK and international law firms with an interest in this vital economic region.
The participants spoke on legal regulation specifics and good business practices in their relevant jurisdictions and on the aspects of foreign investment and dealing with local government issues, with special focus on M&A market, making practical recommendations on doing business in the CIS region. The discussion also covered the region's economic climate and the most topical taxation and legal developments.

CIS Leading Counsel Network (LCN) to Act as the CIS Partner of International Awards Best Legal Departments – 2011

On October 28, 2011 the Renaissance Monarch Hotel in Moscow will host an awards ceremony of the International Awards Best Legal Departments – 2011. This year CIS Leading Counsel Network (LCN), a network bringing together leading law firms in the CIS, will act as the contest’s partner representing the CIS.

The Best Legal Departments – 2011 is an annual contest organized by leading legal publication The Corporate Lawyer and Wolters Kluwer. It assesses the work of legal departments in various categories. Over the past six years the contest has become the most prestigious professional award in the legal community. This year the contest will be attended not only by Russian nominees but also companies from the CIS countries.

The winners will be selected by the Expert Board members consisting of heads of legal departments, including last year’s winners, and partners from the CIS leading law firms.

On 16 August 2011, the Expert Council meeting dedicated to consideration of the Draft Law on Introduction of Amendments into Certain Legislative Acts of the Republic of Kazakhstan on the Issues of Competition, was held at the Agency of the Republic of Kazakhstan for the Protection of Competition (Antimonopoly Agency).

Yelena Bychkova, AEQUITAS associate and member of the Non-Profit Partnership "Competition Support in the CIS," took part in this meeting of  the Expert Council, presenting her proposals on the introduction of amendments into the current antimonopoly legislation of the Republic of Kazakhstan and commenting on certain Draft Law provisions developed by the Antimonopoly Agency.  

 

The Draft Law is aimed at bringing the normative legal base of the Customs Union member states into compliance with the Agreement on Unified Principles and Rules of Competition (Moscow, 9 December 2010), as well as at further improvement of the current antimonopoly legislation of the Republic of Kazakhstan.


CIS LCN shortlisted for The Lawyer European Awards 2011

After the outstanding success of The Lawyer European Awards 2010, The Lawyer once again turns its attention to recognising the achievements of law firms based on the Continent. This year the awards travel to Geneva where, on 28th September, Europe’s finest lawyers will once again gather to celebrate the most outstanding work in the industry over the previous 12 months. On 24 March 2011 a regular meeting of the members of LCN-network took place in in Dusseldorf (Germany).  The main theme of the meeting was as follows: How to do it without mistakes?  The key problems, chances and risks for investments in Russia and the CIS-member states.  AEQUITAS Law Firm was represented by Managing Partner Olga Chentsova and Partner Yelena Manayenko.

On 22 April 2011 the  IX International Atyrau Legal Conference (KPLA) was held in Atyrau.  AEQUITAS’s Managing Partner Olga Chentsova (Vice-President of KPLA) and Partner Yelena Manayenko participated in the conference.  Olga Chentsova presented a report «Subsoil use contracts and other contracts in the new RK Law on the Subsoil and Subsoil Use».


On 28-29 April 2011 Kazakhstan International Conference and Exhibition on Labor Protection - KIOSH – 2011 – was held in Astana.  The conference was attended by Partner Yuliya Chumachenko and lawyer Larissa Yemelyanova and they presented a report «Legislation on industrial safety and labor protection: possible ways for improvement».

March 23, 2011 – The CIS LCN has been chosen as the joint winner of a prestigious IFLR 2010 “M&A deal of the year” Award for its role in Danone-Unimilk merger. The IFLR 2010 Awards have chosen a team of legal advisers who worked on the deal and demonstrated high quality legal advice combined with outstanding customer service and coordination.

 

Danone and Unimilk have finalized the merger of their Fresh Dairy Product businesses in Russia and other CIS member countries in November 2010. The new entity would span the operations across Russia, Belarus, Azerbaijan, Kazakhstan and Ukraine as well as create opportunities for further expansion and will account for around 21% of the total market with currently estimated sales of over USD 2.4bn.


Danone’s legal advisers in Russia, Belarus, Kazakhstan, Ukraine and Azerbaijan were member firms of the CIS Leading Counsel Network (CIS LCN), a network of leading law firms providing integrated legal advice across the CIS region: Egorov Puginsky Afanasiev & Partners (Russia), Vlasova, Mikhel & Partners (Belarus), Aequitas (Kazakhstan), RULG (Ukraine) and FINA (Azerbaijan). On 18-19 November 2010, Almaty was welcoming the 5th Annual Kazakhstan Corporate Lawyers Forum, at which AEQUITAS Law Firm won the International Arbitration Team nomination.


On 25-26 November 2010, Moscow was welcoming the Law Firm Management Conference organized by the Law Firm Management Committee and the IBA European Forum in cooperation with Legal Studies.RU.  The Conference was attended by AEQUITAS Partners Olga Chentsova and Yulia Chumachenko.  AEQUITAS PR Manager, Sergey Korovnikov, participated in a parallel session of the Conference dedicated to marketing in legal business. 


24 November 2010.  Planning of Law Firm Practice Development Seminar brought together in Moscow 19 representatives of all member firms of LCN.  AEQUITAS was represented by its Partners, Olga Chentsova and Yulia Chumachenko and PR Manager, Sergey Korovnikov.
The seminar participants highly appreciated the up-to-date information and quality of presentation by Alexander Khvoschinsky (LegalStudies.RU).
This was the second seminar in the framework of LCN unification professional training program (the first was LCN Summer School on 18-22 June 2010).

On 23 November 2010, AEQUITAS Senior Advisor, Violetta M. Kim, took part in the 1st Ukrainian International Conference "International Dispute Resolution: Ukraine, Russia and CIS Countries."  The Conference was held in Kiev under the aegis of the Arbitration Committee and the European Forum of the International Bar Association (IBA) and the Ukrainian Bar Association (UBA).
At the Conference, Mrs. Kim spoke on Enforcement of Foreign Judgments and Arbitral Awards in Kazakhstan.

On 5-6 November 2010, NURIKON company held a seminar in Almaty entitled “New Normative Legal Acts of the Law on Subsoil and Subsoil Use (dated 24 June 2010) and Their Application by Mining Companies,” which was attended by AEQUITAS Associate, Valikhan Shaikenov.
The seminar’s business coach was the Deputy Director of Subsoil Use Department of the Ministry of Industry and New Technologies (Astana), Nayman Ye. Yeskenov.
The seminar discussed such issues as development of subordinate legislation of the Republic of Kazakhstan for the study and use of subsoil in connection with the adoption and enactment of the RK Law on Subsoil and Subsoil Use, certain issues of the Central Commission for Exploration and Development of Deposits (CCEDD), contractual work programs and their amendment, and explanation and contents of 69 normative legal acts, including practice of their application.

On 2-6 November 2010, American Bar Association organized the 2010 Fall Meeting in Paris.  AEQUITAS was represented by two Partners, Olga Chentsova and Tatyana Suleyeva, participating in the International Law 2010 panel.

AEQUITAS Partner, Yelena Manayenko participated in the 2nd IBA Russian and CIS Merges & Acquisitions Conference held in Moscow on 28-29 October 2010.  The Conference was organized by the IBA Corporate and M&A Law Committee and the IBA European Regional Forum together with “Mergers and Acquisitions” magazine.

On 28-29 October 2010, Semen Issyk, AEQUITAS Partner, was a speaker at the Kazakhstan Issuers Forum held in Almaty.  Semen’s report entitled “Debt Restructuring: Lawyer’s Advice” prepared on the basis of AEQUITAS rich and versatile practice was met with the audience’s keen interest and received much positive response by the conference participants, which included many representatives of governmental agencies, professional public associations, specialized press, professional market participants and companies.

14 October 2010.  Kazakhstan law firm AEQUITAS and Belgian law firm Lydian signed a Memorandum on Cooperation and  Further Development of Interstate Support, particularly in logistics and energy sectors, at the Intercontinental Hotel, Almaty.  AEQUITAS Managing Partner, Olga Chentsova, and Lydian Partner, David Haverbeke, signed the documents in a solemn ceremony in the presence of Prince Philippe of Belgium.

On 30 September 2010, Grand Tien Shan Hotel hosted the “Legal Business.  Central Asia” Forum organized by VIProMotion Corporate Communication Agency and attended by AEQUITAS partners Olga Chentsova and Natalya Braynina, with Olga Chentsova speaking on the topic of Law Firm Development Strategy in Kazakhstan.
This Forum is intended to be held annually to provide an information communication platform for the most active and successful representatives of the legal business community in Central Asia.

On 20-21 September 2010, AEQUITAS partners, Olga Chentsova and Semen Issyk attended the UK International Financial Services Forum in London.
The Forum comprised three days of high-level conferences, formal and informal networking with UK financial services practitioners and exclusive social events.  There was also a major exhibition featuring financial services industry stakeholders.

For qualification advancement purposes, AEQUITAS associates Valikhan Shaikenov and Lyailya Tleulina took part in the seminars “International Taxation Principles”  (9 September 2010) and “Transfer Pricing Basics” (10 September 2010).
The seminars were organized by Angels Nika Advisory, a consulting company specializing in taxation,  accounting and tax reporting matters.

In September 2010, AEQUITAS partners team expanded to include two firm’s senior lawyers – Yelena Manayenko and Semen Issyk.  The new partners will continue working in their respective areas of practice in which they are already established as expert lawyers. 

On 27-28 August 2010, Astana hosted an International Scientific and Practical Conference “Constitution: A Basis for Democratic Development of State,” which was attended by Olga Chentsova and Yelena Manayenko.
This Conference organized by the Constitutional Council and Parliament of the Republic of Kazakhstan was attended by the Head of State, Nursultan A. Nazabayev, heads of country’s central governmental authorities, representatives of authoritative international organizations and legal advocacy institutions, foreign parliaments and constitutional control agencies, as well as by renown law scholars.
The Conference was held in a plenary session format and panels dedicated to the public-and-law, private-and-law, judicial and law enforcement, and administrative-and-management topics.

An anniversary 5th CIS Local Counsel Forum was successfully held in Minsk on 23-25 June 2010 and traditionally attended by AEQUITAS Partners, Olga Chentsova and Tatyana Suleyeva.  The host party this year was Belarus’s leading national firm Vlasova Mikhel & Partners. 
The Forum is the main platform in the CIS economic region for wide-scale gathering of lawyers specializing in legal support of business and is held annually in different cities of the region.  Since the first Forum in Kiev in June 2006, the CIS Forum has evolved into an informal network of managing and senior partners of leading law firms from Armenia, Azerbaijan, Belarus, Georgia, Kazakhstan, Kyrgyzstan, Moldova, Russia, Tajikistan, Turkmenistan, Ukraine, and Uzbekistan, as well as partners of international law firms from more than 30 countries around the world.

On 7-11 June 2010, Suzdal (Russian Federation) hosted an extended session of the Board of Federal Antimonopoly Service of Russia, 31st session of Intergovernmental Antimonopoly Policy Council (IAPC) and celebration of the 20th anniversary of Russian antimonopoly agencies – the Competition Day.  The heads of CIS and European antimonopoly agencies took part in the IAPC session.  Our associate Yelena Bychkova attended the events as one of the members of non-commercial partnership "Supporting Competition in CIS," which unites leading CIS lawyers and economists specializing in antimonopoly legislation.

On 7 April 2010, Moscow office of Egorov Puginsky Afanasiev & Partners hosted a workshop CIS Expansion of Russian Business: Legal Practitioner’s View attended by the members of CIS Leading Counsel Network (LCN), including Olga Chentsova, AEQUITAS Managing Partner.  The workshop’s objective was to try and resolve the most burning problems the Russian investors face when doing business in the CIS countries.  After the workshop, all participants had the opportunity to personally talk to the speakers in individual meetings.

On 8 April 2010, Olga Chentsova participated in legal forum hosted by Vedomosty newspaper (Moscow).  The forum was attended by in-house lawyers and leading law firm representatives from the CIS and other countries, who discussed what could be done by the legal community and governments to create comfortable environment for business and shared the experience of particular legislation application (antimonopoly, tax, customs, etc.).  Olga Chentsova and other LCN members spoke in discussions on peculiarities of doing business in their countries.

On 9 April 2010, AEQUITAS partners, Olga Chentsova and Natalya Braynina took part in the VIII ATYRAU INTERNATIONAL LEGAL CONFERENCE – Current Issues and Analysis of Practical Application of Laws in the Oil and Gas Industry of the Republic of Kazakhstan.  This Conference annually organized by KPLA in conjunction with Tengizchevroil LLP is a key event for Kazakhstan’s legal community.
The Atyrau International Legal Conference is annually attended by representatives of foreign and national petroleum companies, law firms, scholars, oil industry workers and  governmental officials who come to discuss Kazakhstan’s policy in the oil and gas sphere, significant novels and amendments in the subsoil law of the Republic of Kazakhstan and related issues.
 
At this Conference, Natalya Braynina delivered report Legal Regulation of Economic Concentration in the Republic of Kazakhstan.
