AEQUITAS litigation team has successfully completed representing White & Case Kazakhstan LLP (Kazakh office of White & Case international law firm) in court in a tax dispute.
Following a tax inspection, White & Case Kazakhstan LLP was charged with unlawful payment of the parent company’s income without deduction of applicable taxes, as well as misuse of the Convention on the Avoidance of Double Taxation between Kazakhstan and the USA. The Tax Committee’s claims amounted to more than USD 1,300,000.
The tax service based its findings on the wrongful, in its opinion, apostilization of the provided residence certificates. White & Case Kazakhstan LLP appealed the actions and acts of the Tax Committee of the RK Ministry of Finance in court, however, the first three judicial instances (first, appellate and cassation) ruled in favor of the Tax Committee.
AEQUITAS lawyers were representing White & Case Kazakhstan LLP in the supervisory instance. The RK Supreme Court ruled in favor of White & Case Kazakhstan LLP, declaring the Tax Committee’s notifications unlawful.
